1. Acceptance of Terms
By requesting a service from Diesel and Dust Towing & Auto (the "Company"), whether via phone, website, or in-person, you agree to be bound by these Terms and Conditions. These terms apply to all services including, but not limited to, towing, roadside assistance, boosting, lockout services, fuel delivery, and tire changes.
2. Service Authorization
You represent that you are the legal owner of the vehicle being serviced or are an authorized agent for the legal owner. You authorize the Company to perform the requested services as agreed upon at the time of dispatch or on-site arrival.
3. Payment & Pricing
- Estimates: Any price quoted over the phone is an estimate based on information provided by the customer. Final pricing may vary based on actual work performed, equipment required, or unforeseen complexities on-site.
- Payment Terms: Payment is due immediately upon completion of service unless prior credit arrangements have been made (e.g., commercial fleet accounts).
- Wait Time: The Company reserves the right to charge for excessive wait times caused by the customer once our operator has arrived at the location.
4. Cancellation Policy
Cancellations made after a service vehicle has been dispatched may be subject to a "Gone On Arrival" (GOA) or dispatch fee. The amount of this fee is determined by the distance traveled and the nature of the recovery equipment deployed.
5. Liability & Damage Claims
- Professional Standard: We pride ourselves on damage-free recovery. Our operators use industry-best practices and equipment.
- Pre-existing Conditions: The Company is not responsible for damage resulting from pre-existing mechanical failures, rust, fluid leaks, or structural weaknesses of the vehicle.
- Unauthorized Recovery: If a customer requests a recovery method that our operator deems unsafe or likely to cause damage (and the customer insists), the Company will not be held liable for any resulting damage.
- Reporting: Any claims for damage must be reported to the operator at the time of service delivery and followed up in writing to [email protected] within 48 hours.
6. Right of Refusal
The Company reserves the right to refuse service if the operator determines that the scene is unsafe, the request is illegal, or if the customer is abusive or dangerously intoxicated.
7. Governing Law
These terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein.
8. Modifications
We reserve the right to modify these terms at any time. Your continued use of our services following any such modification constitutes your acceptance of the new terms.
